2011 National Legislative Program Priority: Legal Reform for Right to Food, Peasants’ and Fisherfolk’s Rights Protection

Since 2007, Indonesian Human Rights Committee for Social Justice (IHCS) together with several other civil organizations have been initiating legal reform on several Acts, namely; Act no 7 year 1996 on Food, Act no 31 year 2004 on Fishery (revised to Act no 45 year 2009) and Act no 27 year 2007 on Coastal and Islets Management.

This year, all the reform proposals are successfully entering the 2010 – 2014 National Legislative Programs (Prolegnas). There is also another proposal regarding agrarian reform and producers’ (peasant, fisherfolk and indigenous people) right to food, however because of administrative reason, the proposals could not be received by Legislative Body. In order to push these initiatives to be in 2011 Prolegnas Priority, it is important for the academics, legislators, legal reform initiators and government officials to unify perceptions regarding the importance of above acts.

Maklumat Penyelamatan Pesisir dan Laut Nusantara

Lebih satu dekade upaya pemerintah menyelesaikan krisis kelautan, melalui Kementerian Kelautan dan Perikanan (KKP), tidak membuahkan hasil yang signifikan. Kini, ekonomi nelayan dan petambak semakin terpuruk, akibat lemahnya perlindungan pemerintah atas tambak-tambak dan perairan perikanan rakyat, minimnya permodalan, sulitnya mengakses bahan bakar, hingga teledor memberi berbagai kemudahan untuk pelaku usaha (termasuk asing) mengeksploitasi sumberdaya kelautan dan perikanan nasional secara tidak berkeadilan dan tidak berkelanjutan.

Prioritas Prolegnas 2011: Pembaruan Hukum untuk Perlindungan Hak Atas Pangan, Hak-hak Petani dan Nelayan, serta Pembaruan Agraria

Semenjak tahun 2007, Indonesian Human Rights Committee for Social Justice (IHCS) bersama sejumlah organisasi masyarakat, mengajukan inisiatif perubahan (legal reform) atas Undang-Undang Nomor 7 Tahun 1996 tentang Pangan, Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan (sudah direvisi menjadi Undang-Undang Nomor 45 Tahun 2009), dan Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil dan berhasil masuk dalam Program Legislasi Nasional 2010-2014. Sesungguhnya masih ada tema lain yang terkait pembaruan agraria dan perlindungan hak-hak produsen pangan (petani, nelayan, dan masyarakat adat) yang diusulkan, namun hanya tiga hal tersebut yang lengkap adminitrasinya, yaitu adanya naskah akademik dan rancangan undang-undang dan sudah didaftarkan ke Baleg DPR RI.

NGOs seek to scrap law on coastal management

The 2007 Coastal and Islet Management Law is yet to be functional, but an alliance of activists are already seeking to shoot it down.

An alliance of NGOs have filed for a judicial review with the Constitutional Court to have the law revised or even scrapped as they claim it will see the state surrendering its sovereignty to capitalists.

The group says the law gives business entities the right to manage a particular area and share the profits with the local government,  which will effectively rob indigenous po-pulations of their ancestral homes and livelihood.
